Dear Sir or Madam
Re: Withholding of publications - Fight Racism! Fight Imperialism! (FRFI)
We are writing further to previous correspondence on this matter last year. At that time, a number of subscribers to our publication in both Wakefield and Woodhill prisons complained that they were being prevented from receiving the publication. This was resolved following correspondence with the Director of High Security and both establishments agreed to issue further issues of FRFI without interference.
We have now heard from Leroy Smith (EP2113/A9645AC) who has not received the past two issues (#213 February/March 2010 and #214 April/May 2010). Both were sent recorded delivery, with a further copy of #213 sent normal post. Neither have been received. We therefore request that these newspapers are issued to Mr Smith immediately, that he receives an apology for the inconvenience and that neither he nor any other prisoner in Woodhill who subscribes to our newspaper is subject to this interference in future.
FRFI is legally published in Britain and distributed both here and abroad. There is nothing within its pages which would support its withdrawal because of ‘the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary’ (Article 10 of the European Convention on Human Rights).
We have no desire to pursue this matter through the courts but will not hesitate to do so if it becomes necessary. We therefore ask that you immediately provide the copies of Fight Racism! Fight Imperialism! 213 and 214 to Mr Smith and any other subscribers within Woodhill prison, to whom it has not been issued. If you are not prepared to do so, we request that fully detailed reasons, with reference to specific articles, for your refusal to do so, are provided to us by return so that we can seek urgent legal advice on judicially reviewing your decision.
