Ponies are being ill treated in Jammu and Kashmir, some ponies are used to carry goods in night but these animals are left un attended in day times as stray, some used to ride as vehicle - no food, no shelter, treatment and care for them. As J&K have special status given under 370 Indian Constitutionals provisions.....hence no Indian laws are enforce over there....Indian Panel Code replaced by Ranbir Panel Code along with separate laws of the land. The Prevention of Cruelty to Animals Act, 1960 - all rules made under section 38 of this act replaced by the Jammu and Kashmir Prevention of Cruelty to Animals Act, 1990.

A team of the International Organization for Animal Protection - OIPA in India along with the activist of the People for Animals (PFA) Haryana led by Naresh Kadyan visited Jammu, Katra and holy cave shrine of Maa Vaishno Devi to investigate the cruel / ill treatment with the Ponies over there, team found very cruel treatment with these poor animals for individual profit for personnel gain and animal suffered a lot. Naresh Kadyan taken up this matter with the Chief Minister and Director General of Police, Jammu and Kashmir along with the local administration.

We are in receipt of your E-Mail dated 06-07-2009 with regard to Cruel/ ill-treatment being meted out to the ponies. In this behalf, it is intimated that the issue raised by you stands referred to the concerned quarters for enquiry and appropriate corrective/punitive action on priority.

As per section 3, 11 and 38 of the Prevention of Cruelty to Animals Act, 1960 - cruel treatment with the animals is a non-cognizable crime in legal terms with minor punishment for rest of India except Jammu and Kashmir but as per Jammu and Kashmir Prevention of Cruelty to Animals Act, 1990 also protect these animals from un-necessary pain and sufferings but the punishment defined very minor for the violation of the said act.
The International Organization for Animal Protection - OIPA in India in the opinion that 370 provisions are the political compulsions then why animal suffered due to 370 special status for the state, People for Animals (PFA) Haryana raised this issue under the right to information act, 2005 with the Speaker Lok Sabha but no attention given to resolve the issue yet by the central, J&K Govt. as well.
