John Peter Bauskis, the court having ordered that he should not remain in court whilst wearing a tshirt containing the words in large letters, "Trial by Jury is Democracy" did refuse to leave the court and refused a lawful direction to leave made by the officers of the Sheriff. How do you plead, are you guilty or not guilty?
BAUSKIS: I am not pleading anything.
HIS HONOUR: Enter a plea of not guilty.
BAUSKIS: I am a sovereign person, you have no rights over me.
HIS HONOUR: You are both in custody.
BAUSKIS: Illegally.
HIS HONOUR: I think it is imperative that you obtain legal advice and I am prepared
BAUSKIS: For what?
HIS HONOUR: I am prepared to consider whether or not you should be granted bail. Do you seek bail?
BAUSKIS: I seek nothing. This court has no jurisdiction. I would like to apply for a jury myself.
HIS HONOUR: I think you should really consider whether you wish to remain in custody or, having been charged, whether you should seek bail.
BAUSKIS: I have not done anything wrong. Why should I seek bail?
HIS HONOUR: I suggest you seek bail. I am not in a position to consider whether you should remain in custody or not.
UNIDENTIFIED MEMBER OF PUBLIC: You can't judge in your own court.
BAVSKIS: In your own cause.

Read Peter's open letter;
Dear Friends and Fellow Australians,
My name is Peter Rutherford and I have a very grave and important story to relate to you. This story is not just about me and my family, but also about you and your families and friends.
My story began last Monday 24th July 06, in The Supreme Court of NSW, Sydney. Australia.
My self, and my 17yo daughter (and about 30 other supporters) came in peaceful support of two fellow Australians, asking for justice to be served (a trial by jury) in their matter.. We wore a T?shirt with words "Trial by Jury is Democracy". "Trial by jury is democracy".
For whatever reason the Judge (Michael Adams) took offence to that.
Adams ordered us all to remove the T-shirts or he would have us arrested.
I, in my sovereignty, felt it was unjust, unfair and unlawful to ask me to remove that T?shirt under threat of arrest. We refused to remove our T?shirts. John Bauskis was first and I was the second to be arrested. I resisted by grabbing a wooden hand railing which broke off . We were both handcuffed and dragged down to the cells
We were held in jail for one night We were then brought back before Judge Adams on Tuesday morning and asked if we would apologise. We said NO, we have done absolutely nothing wrong.
We have been charged with ‘Contempt of Court’ and have to appear back in the Supreme Court this Friday 4th Aug at 10am. It is very probable that Judge Adams will put us both in jail. He can hold us there indefinitely under this corrupt and unlawful charge, under the new Terrorist laws that have now been introduced in Australia.
This blatant abuse of power will pass on through all the courts if we allow Adams to get away with this. John & I are willing to stand up for our rights (and yours) even though it is extremely frightening.
I have a wife & family who are distraught at the thought of me going to Jail. It will destroy the life we have. I will lose my job, and will have a criminal record.
Pete Rutherford is a really decent bloke who has worked extremely hard in his fifty three years of life, about half of this time spent farming on a variety of farms and stations around Australia, and the other ‘half’ involved in ecological education and human rights.
Peter has been for the last seven years, and still is, running a hugely successful Environmental education center at ‘KIMBRIKI’ recycling and Waste Management Centre’ under contract to the four ‘north of the harbour’ councils, ie Mosman, Manly, Warringah, Pittwater.
His many references include such praises as: …a Gifted Educator, Honest, Reliable, ….undoubted integrity, ….a Passionate Human Being, … a loving Father of two girls 17 & 20 yo, innovative, conscientious, …straightforward approach to life, …etc…………….,
Peter has lived his life in a peaceful and loving way since he had his first daughter 21 years ago, then his second daughter
If you have the time to join us and our friends at the Supreme Court (Old Court in King St, Sydney) this Friday 4th August, at 10am we would be blessed to have you there.
We feel that if we can get a show of a large number of concerned Australians then we may have a chance if not being thrown in Jail.
The media, so far, have kept totally away from this story. Why? We don’t know.
