Abhishek Kadyan, Media Adviser to the OIPA in India | 24.07.2009 16:22

Public Prosecutor being an public servant do not have any authority to conduct media briefing and press conference, he can not disclose modus oprendi nor proceedings of the court before media publicly......

There are certain rules, guideline or legislation to administer our system here in India but we have seen in so many high profile court cases, few faces of Public Prosecutors comes forward in media for press briefing, updates the knowledge of media persons...press but are they authorized to do so as per conduct rules for public servant, bar council as well?????, definitely not then how they accept gift from a political party....sharing their stage, might be violations of the conduct rules for public servant?
Media and press follow only high profile cases at large and in major high profile cases only appropriate forum like press information bureau of the Govt. may be allowed for any disclosure, information about development of the matter avoiding secret information which hurt the prosecution or natural justice, where as no one is interested in low profile or routine court cases.
Naresh Kadyan, Representative of the International Organization for Animal Protection - OIPA in India asked the bar council of India, all state bar councils to look in to for strict compliance of their instructions framed for their members, Govt. agencies also have to check them as per their public servant conduct rules.
