CSFB Bankers on Rape Charges

two Credit Suisse First Boston bankers have appeared in the Old Bailey (City of London) accused of raping two women at an exclusive penthouse party.
[Three city bankers] were arrested on July 20th... all denied conspiracy to rape, at the Old Bailey on Dec 5th.
[One] has been suspended from his job as vice-president of risk equity trading at CSFB since the allegations were made, also denies raping the two women at his penthouse in Soho.
[Another], from Bermondsey, who was an associate in pan-european UK sales at the bank, has already been made redundant...
Judge Giles Forrester gave the three bail under strict conditions and ordered they return to the Old Bailey on Jan 23rd 2002...
A spokesman for CSFB dclined to comment.

Conclusion of Opinion of David Pannick, QC:

"In my opinion, it is plain that Mr Castrounis should not have been prosecuted. There was no evidence on which charges could properly be based. Indeed, the evidence strongly refuted the allegations made by the women. The charges were eventually dropped because the CPS rightly recognised that Mr Castrounis had no case to answer. It is very regrettable that because of police incompetence it took so long for this obvious fact to be recognised."

Comments from Judge Bathurst Norman

On 15 April 2002 at the costs hearing, His Honour Judge Bathurst Norman, in awarding a Defendant's Costs Order to Mr Castrounis, expressed his view that it was a scandal that the Police had not sent the papers to the CPS for advice at a far earlier stage, preferably before charge. He further criticised the Police for the over-zealous conduct and commended the CPS for their expedient decision to discontinue the matter once they had eventually been provided with the papers by the Police.

The following are quotes from the judgment of His Honour Judge Bathurst Norman at the costs hearing when he observed as follows:

"It seems a vast number of these difficulties have been caused by a very over-enthusiastic Police officer".

He continued as follows:

"Common sense has seemed to have gone out of the window".
