POSSESSION? OR INVASION?

Deb Stevens | 25.11.2004 00:36 | Repression | Liverpool | London

The legislation is expected to introduce a new definition of "possession" of an illegal drug, making it an offence to have a certain amount in the bloodstream. This is likely to prove controversial - not least because some drugs, such as cannabis, can remain in the bloodstream for weeks.

UK: This absolutely preposterous idea/theory of allowing a person/s to be possibly charged with 'possession', if found to have a drug substance within their bloodstream, just goes to prove such hypocrisies which certain hierarchies feel justifies passing legislation, is another blow for democracy!

To even consider the notion of passing such legislation shows real concern for the future of our well being and the greater need for us as a society to have the rights and power to protect ourselves from any further infringement by intrusion!

Here in Australia, we have had to cop many 'stand over tactics' and still continue to fight for our rights. Just how much more are we as a people going to stand for and what will the consequences be?

Imagine if you will, the amount of people appearing before our courts if this pathetic attempt to criminalise every single human being for having some sort of drug substance in their very own blood!

We are in the midst of a crisis trying to cope with the already over populated prison system, which sadly is mainly due to the amount of people within society living with a drug dependency of some sort.

This is not about possession...this is purely an over zealous ambition AND obsession of the egotistical politicians who pursue any means of demoralising fellow man!

The definition of possession means simply:

(Act or fact of possessing, ownership).

When can I be charged with a drug offence?

You can be charged with a drug offence if you:

Have possession of a dangerous drug (including marijuana, heroin, cocaine, angel dust, LSD or speed). [Drug Misuse Act. 1986. s10]

Have possession of property (other than a syringe or needle), which police believe is to be used to commit a drug offence. This includes having a bong or a pipe on you, even if it hasn't been used, or having something which has been used to commit a drug offence and you cannot give a good reason for having it.

Supply a dangerous drug (give, sell, deliver a drug to someone else or offer to do this).

Produce a dangerous drug (grow, prepare and package a dangerous drug or offer to do this).

Being the occupier of a place you allow it to be used for drug offences. This is important for people in share accommodation who know housemates or friends of house-mates are using drugs on the property. Instead of the police having to prove you knew what was going on, it is assumed you knew and you have to prove you didn't know.

Trafficking a dangerous drug (dealing, making a profit).

The sentence for these offences will depend on the drug and how much there is of it. If you are charged with producing or possessing heroin or cocaine and you can prove you are drug- dependent the court will take this into account when sentencing you.

More than one person can be "in possession" of drugs at the same time. For example if a number of people in a room are smoking marijuana, they may all be "in possession" of the drug being smoked or the thing being used to smoke it. It is not just the person who is actually using it when the police arrive that could be charged.

Feel the Fear

25.11.2004 10:17

The British are petrified by their own shadow, according to opposition leader Michael Howard; they are afraid of al Qaida, naturally, although Muslims never actually attack us, but “eighteen year-olds who tip over rubbish bins” (happens all the time) are a far greater terror and people find it so intimidating, they are afraid to go outside. “We need better security” they wail and beg for more police and less bins. The fear is tangible as they cower behind the State for protection.

It’s not sufficient for the Conservatives Party that New Labour has abolished civil liberties altogether and replaced them with biometric I.D’s and total surveillance, that does not go far enough. Indefinite detention without trial by jury, on the suspicion that one may commit a crime, sometime... is too lenient; the Tories would like the whole populace born on parole, better safe than sorry. The only rights we will have are to be micro-chipped and die by euthanasia when our uses are exhausted.

In the interim, we will ‘Labour’ to build record prisons to accommodate offenders, like ourselves, while Howard recruits a whole army of police with tazers, battons and CS gas and that is just to catch felons fast-forwarding the adverts on DVD’s, or people with cannabis in their bloodstream. Ashtray violation... go, go, go...! What? Too many able bodies languishing in jail? Okay, the military is in dire need of soldiers to expand the Middle East conflict, convicts make good cannon fodder.

Although I too share this "vision of the future" (I am absolutely convinced of it) ..

.. I should also like to point out that little thugs who tip over bins ARE a terrorist menace. Especially the ones opposite my house who regularly commit acts of vandalism (they set fire to my house recently).

I would go further than Howard in dealing with these little bastards. But sadly if I was to lay a finger on them it would be I who was hauled up in front of the beak.

Shame. I want to rip their balls off.

Peacelover.

But this time nobody would haul me up in front of anyone. Violence against a twat leftie would simply be applauded by the likes of the Sun and the Daily Mail.

Shame I fucking hate all them too.

Can't win eh?

What did he/she ever do to you, "firestater"?

25.11.2004 20:30

Apart from saying how sick he/she is of being intimidated by anti-social thugs? Do you support people tipping over bins, or breaking windows, or worse? When people are forced to endure this they are rarely going to be all enlightened and sympathic now.

You are pathetic twat, "firestarter".

someone in the real world

Hmm

25.11.2004 21:37

"Firestarter", you say that people should go out and start a youth club. Have you visited planet earth recently? Kids don't want to go to a youth club these days. Walk around my neighbourhood and ask them why they aren't at the local youth club and you will get a mouthful of abuse. Being 'understanding' of these yobs only goes so far, you can only do so much with them before you have to get 'tough' on them and show them that society can punish those who make other people's lives a misery. We don't live in a society of constant 2nd chances.
Visit the planet some time and you'll see that your strategy only goes so far before other things have to be done.

Bill

The kids are bored shitless.

26.11.2004 10:27

All former youth facilities in inner-cities are defunct and derelict and every piece of grass or open space has been commandeered by exclusive private flats whose residents resent the kids on their doorstep.

Visit Hackney, where they spent £60 million on Town Hall renovations and zilch on the general community, it's a freakin' disgrace. The Black Hole of Calcutta is more inviting.

The buck stops with the government scum who spend our hard earned taxes on fuck all, except white elephants, more prisons, arms and war. That's the reality on my planet.

Don't worry though peacelover, there is a 9:00 curfew and the youths who dare to go out, face jail, which is where you want to see them, right?
