Please take note of the following.

The defendants have asked that there are no demonstrrations outside the court whilst sentencing is in progress we are asking that people respect their wishes.

There are demonstrations at laboratories and other sites connected with abuse.
on Thursday 21st October there will be a demonstration at HLS Occold in Suffolk 12.00-18.00, on Friday 22nd October there will be a demonstration at HLS Wooley 12.00-18.00 or do something closer to home.

As the new Novartis injunction isn't actually available online (or anywhere to be honest!!! - SHAC haven't even been served yet!!) we are thinking of popping into the Novartis sites in Hedge End and Bordon, perhaps do a demo outside the injunction area (however who will we know where that is?).

I guess we could quite legally knock on Novartis's door and ask for it.

See you tomorrow or maybe Friday/Monday Novartis - be ready to serve us with you special injunction (if it actually exists!!!)

Re alleged injunctions

Injunctions can be served simply by telling people about them. It is best not to mention them online. It is a defence to breach an injunction if you were not served with it. If the police can prove that someone has read this bit of Indy' they might use at as evidence against someone using ignorance of a court order as a defence in court.

Lynn the problem is that the new Novartis injunction isn't publically available (unlike all other injunctions) - it hasn't been served on SHAC and isn't freely available so it could easily be argued it is not inforceable. It is the first time legally this has happened in terms of high court injunctions. It is also further confused by the existence of several previous injunctions.

So you have no way of knowing where the protest sites are, what number to phone to inform about a demo or anything else. We know it's not the old numbers.

This appears to be a deliberate Novartis tactic of keeping the terms of the injunction and the injunction itself out of the public domain. If it is out of the public domain you can't do demos legally as you know there is an injunction (as there was a previous injunction) but you can't follow the terms of the new injunction as you don't have access to them.

Normally we would just turn up do a normal demo and then get served however that would be breaching the old injunction and the police wouldn't believe you didn't know about it.

The fact that Novartis have a civil injunction has been mentioned many many times on the SHAC website and on indymedia etc. Anyone wanting to look up where the locations were (to do a demo) would certainly hit something mentioning it so I can't see why we can't mention it here. Especially as the injunction might not actually be inforceable as it isn't in the public domain.

I was just saying that as the BEST defence for any injunction is ignorance arguably of course. SHAC regrettably are forced by the High Court to put them up. Indy' is not.
