Dear Mr Malyn,

Thank you for your letter of 15 January 2010. Ref: Unlawful
appointment of Ms Janet Relfe by B&NES Council’s Chief Executive with
her remit being to look into allegations of misconduct by the
Council’s Chief Executive

Thank you confirming you have found that:

1) The Council has little by way of a written record of Ms Relfe’s
£12000 appointment (for 5 days work) or the manner or basis of the
decision except for a note prepared by the Chief Executive which is
dated some six months after the initial decision to appoint Ms Relfe
was made.

2) The appointment of Ms Relfe was made by the Chief Executive

3) Standing Orders were not fully complied with by the Chief Executive
in respect of value-for-money criteria and the rules governing
agreeing the purchase / contract award

4) It might be arguable that the appointment of Ms Relfe was not
properly made by the Chief Executive.

Please note I will be making further objections in the coming months regarding:

a) the Chief Executives wilful refusal to pay me the £500 compensation
awarded to me by the LGO last year as a result of B&NES Council’s
legal department losing a confidential legal file it used to hold on
me

b) the all expenses paid holiday to China last year made by the
Council’s Chief Executive accompanied by his wife, Cabinet Leader Cllr
Haeberling and Cabinet member Cllr Hanney which cost the B&NES
taxpayer £8000 an expenditure which I do not believe was lawfully
authorised
