Demonstration in Westminster against the criminalisation of the possession of pornography which features consenting adults, and for freedom of speech and the freedom of consenting adults to express their sexualities.

CAAN are back in London again on 21st October, supporting Ben Westwood to do a little stunt, to protest and raise awareness about the kinky porn ban and campaign for the freedom of consenting adults to express their sexualities.

We've tried being reasonable and now it's time to be a little bit more interesting..

** addition** we've been asked to confirm this is a non violent action - yes it is non violent and violence will not be tolerated. There is a coach from manchester - memo me if you are interested or see separate post about it further into this thread - we still have some spaces left.

Please can you give more information on this, it sounds interesting. Is this protesting a new law that is to come into effect? Is the state about to become interested in our bvedrooms as much as they are interested in our inboxes?

Basically, in June the government brought in the 2008 Criminal Justice act which, amongst a whole host of amendments to previous versions, has made it illegal for one to view and possess certain forms of pornographic images.

Part 5 of this act is where the specifics can be found ( http://www.opsi.gov.uk/acts/acts2008/ukpga_20080004_en_9#pt5). Briefly, it focuses on the subjective interpretation of what is deemed an 'extreme' image which, under the current terms of reference, can include BDSM images of scenes between consenting adults i.e. such as breast binding, needle play and scarification.

And I quote,

"(6) An “extreme image” is an image which—

(a) falls within subsection (7), and

(b) is grossly offensive, disgusting or otherwise of an obscene character.

(7) An image falls within this subsection if it portrays, in an explicit and realistic way, any of the following—

(a) an act which threatens a person’s life,

(b) an act which results, or is likely to result, in serious injury to a person’s anus, breasts or genitals,

(c) an act which involves sexual interference with a human corpse, or

(d) a person performing an act of intercourse or oral sex with an animal (whether dead or alive),

and a reasonable person looking at the image would think that any such person or animal was real."

It also states that 'consent' can not be used as a defense, which is based upon the precedent set in the Spanner case. See this link for a bit of further info  http://www.spannertrust.org/documents/possession_of_extreme_pornography_share.pdf .

The intent of the act is aimed at abuse proper and not BDSM. That said its positioning and lack of clarification leaves BDSM practitioners and connoisseurs open to arrest prosecution unless, that is, you are rich and possibly have the surname Mosley.

Again and to reiterate, because the terms of reference are so subjective, any outcomes are going to be heavily reliant upon the moral and ethical perspectives of judge and jury.
