Manchester poet fined under draconian “police state” psuedo laws.

This week renowned Manchester poet Carol Batton received a fine under a new Order preventing people from handing out printed Manchester in certain parts of central Manchester.

The new laws came into effect last month and are another toll and infringement on our civil liberties and freedom of expression. Manchester City Council have made an Order under section 94B of the Environmental Protection Act 1990 designating land where the distribution of free printed matter will be controlled.

“The effect of the Order is that any persons wishing to distribute free printed matter must apply to the City Council for a consent and it will be an offence liable on summary conviction to a fine not exceeding level 4 on the standard scale (£2,500) to distribute or cause to be distributed free printed matter without such consent.”

It appears we are also offered terms to deal with the City Rangers or whoever enforces this order and can admit to an offence and pay an £80 on the spot fine or take the matter to court:

“Upon conviction you could be fined up to £2,500. A discharge of prosecution might be offered by payment of a fixed penalty notice. This will cost the offender £80. The distribution literature may be confiscated.”

Some people are exempt from the order, but what constitutes are religious or political organisation remains unclear, at the best of times:

“Registered charities, where literature relates to that charity. Religious organisations and political organisations are exempt.”

We must be aware of the erosion of our abilities and means of expression. It is apparent that this order can be abused and can prevent certain individuals or groups from expressing views and sharing them via a printed form. It also does not cover any organisation who whishes to sell us material which may be harmful and polluting.
