SUPPORT BRIAN IN PARLIAMENT SQ: MONDAY 8 MAY

If you can get down to Parliament Square on Monday morning please come to show support for Brian Haw. Whether or not the appeal goes for or against him, he needs our solidarity.

If the appeal goes against him, he could be evicted immediately or he could be allowed to stay until a further appeal is heard.

We will keep you informed if eviction looks really likely.


BACKGROUND:

MONDAY 8 MAY: DECISION ON HOME OFFICE APPEAL AGAINST BRIAN

On 3 April the Court of Appeal heard an appeal by the Home Office against the decision taken in the High Court last July, that Brian Haw is exempt from the measures in the Serious Organised Crime and Police Act 2005 which ban unauthorised protest near Parliament.

The decision in this appeal case will be heard on Monday 8 May at 10am in Court 71 at the Royal Courts of Justice, the Strand, London. If the Home Office wins this appeal,
that will be mean Brian will no longer be exempt and his demonstration could be removed from Parliament Square.

THE OUTCOME OF THIS APPEAL HAS VERY SERIOUS CONSEQUENCES AND COULD MEAN THAT BRIAN IS EVICTED.

We do not know exactly what will happen if the appeal goes in the Home Office's favour and what the subsequent process will be. Brian's legal team will be seeking to appeal to the House of Lords and will argue that he be left alone until the outcome of the appeal is known.

However, we must be on the alert to show solidarity with Brian down in Parliament Square when this becomes necessary - see below.

DEMONSTRATE AT THE HIGH COURT

There will be a demo in support of Brian from 9.30am outside the High Court on the Strand.

SHOW SOLIDARITY WITH BRIAN DOWN IN THE SQUARE

Brian will not be attending the court so it would be great if people can be in Parliament Square. Whether the appeal goes for or against him, lets us demonstrate that
Brian has our support. There are also likely to be quite a few members of the press there!!

There is some risk of arrest for anyone going down to Parliament Square if the police decide that an unauthorised demonstration is taking place and if they decide to take action. However, there are people visiting Brian all the time without being arrested. But it is important to know what the possible risk is and to be prepared. 2. BE PREPARED TO JOIN BRIAN IN PARLIAMENT SQUARE IF EVICTION LOOKS LIKELY

If the judgement on Monday is against Brian and it looks like he may be evicted then we need people who are prepared to join him. See above for information on risking arrest. Once we know the outcome of the appeal and the likelihood of eviction we will send out more information.
