Swiss police acquitted in Aubonne Bridge trial

laura | 17.02.2006 13:28 | Repression | Social Struggles | Oxford

Two Swiss police officers who nearly killed climbers Martin Shaw and Gesine Wenzel by cutting their rope during the protests against the G8 in Evian, 2003 have been acquitted of causing severe bodily harm with negligence after a private prosecution.

Direct reaction of Martin and Gesine to the verdict as stated in front of the judge:

“What we have seen here during the last three days is exactly the reason why we and thousands of other people like us all over the world think that direct action is the best way to overcome injustice.
The entire judicial procedure from the time the rope was cut has been clear whitewash. The prosecution is supposed to defend the law but what they actually defend is the state – and its officers. This court case has been an elaborate, expensive and time-consuming piece of theatre to provide a platform to find excuses for inexcusable actions and to misguide the public by pretending to provide justice.
This verdict is a pure cover up of police brutality by the justice system and is just further proof of the almost complete police impunity in Switzerland.”

The injustice seen in the Swiss court today is echoed throughout our world. Our anger from watching those two swiss cops walk free from court must be channelled in to makeing them realise that we dont/wont accept their justice, that we don't/wont accept their system. Our thoughts are with you Martin and Gesina and those people supporting you in Switzerland.

Anyone suprised at the verdict should be ashamed of themselves

The police are the thug arm of the state. Sorry, did someone here expect that the state would cut off its OWN arm? What sense would that make?

While courts CAN deliver justice, neighbour against neighbour, they NEVER deliver justice against the state, or those that act on behalf of the state. This isn't my opinion- this is a simple statement of fact.

When you THINK (or better, are mislead by the Mass Media) into thinking that courts have acted against the state, you simply haven't paid enough attention. Usually, these cases involve ex-state people, falling because it benefits those that now run things.

If you think hard enough about this, you will understand why, for instance, the US has the model of supreme courts, but then you will notice that while these courts are solely responsible for upholding the written constitution, politicians get to appoint all the judges that matter, putting the state back firmly in control. This means, for instance, that the US supreme court NEVER truly ended any injustice in the States, because such injustices ONLY ended when there was enough support for those actions amongst the elected politicians there. In other words, even the US supreme court only reflects the desires of the state, and never works against it.

The real question is WHO is responsible for constantly requiring (on Indymedia and other places) that people have faith in the court system? When the state is in the hands of wicked people (and for Switzerland, that has ALWAYS been true), it is the state that must be changed in order for justice to be done. This is a self evident truth, so those that argue for wasted effort in totally corrupt courts are NEVER fighting for the cause, but (foolishly or purposely) against it.

I am not saying that the propaganda value of such obscene verdicts is not of use- on the contary, it can be of vast use. However, I am saying that pre-verdict efforts that pretend the possibility of a positive outcome are a total waste of time. If the state does not want the negative publicity at any given moment in time, it will fix a semi-positive outcome regardless of court arguments.

I make this promise about the Swiss government, however- IT DOESN'T GIVE A DAMN ABOUT BAD PUBLICITY AMONGST THE 'LITTLE' PEOPLE, NEVER HAS, AND NEVER WILL. The Swiss state says that life ONLY has a value when attached to a vault load of cash. They say it loud, and they say it proud.
