Agg. Trespass now chargeable in buildings

As of Monday 20 Jan 2004, aggravated trespass, s68 CJA&PO Act 94, can now be charged in relation to trespass disruptive to lawful activity inside buildings, as well as in the open air.

I feel bad about 'promoting' this extension of repressive law, but the cops will have been briefed on it, and it's as well to be aware of.

The Criminal Justice and Public Order act 1994 was amended by the Anti-Social Behavour act 2003, deleting the words 'in the open air' from section 68. Statuary Instrument 3300 of 2003 brought this into force this monday.

This is a really shit law - it was in 1994 and is even more so now, criminalizing a huge range of possible behaviour. It is still a defence to show that the activity alleged to have been disrupted was not lawful, or that there was no actual activity at the time being disrupted, as in the case GM left to grow.
