Unfortunately, the members of the Bush cabal can not be tried for terrorism under U.S. Code Chapter 18, Section 2337:

"No action shall be maintained under section 2333 of this title [the section outlining punishments] against--

(1) the United States, an agency of the United States, or an
officer or employee of the United States or any agency thereof
acting within his or her official capacity or under color of legal
authority; or
(2) a foreign state, an agency of a foreign state, or an officer
or employee of a foreign state or an agency thereof acting within
his or her official capacity or under color of legal authority."

However, part (2) of this section is very telling of why Bush declines to bring foreign leaders to U.S. courts over terrorism-related (and specifically 9/11-related) charges; the case would not even make it to court, and would expose his allegations of some nations and leaders as "terrorists" as legally unsound under U.S. Code! Of course, this is in addition to the fact that such a trial would necessitate a full investigation of 9/11, which is not likely to happen any time soon.

On the other hand, the Bush cabal, if enough evidence for impeachment/indcitment is presented, is eligible to be tried for war crimes under U.S. Code (as well as international law), Title 18, Section 2441:

"Sec. 2441. War crimes

(a) Offense.--Whoever, whether inside or outside the United States,
commits a war crime, in any of the circumstances described in subsection
(b), shall be fined under this title or imprisoned for life or any term
of years, or both, and if death results to the victim, shall also be
subject to the penalty of death.
(b) Circumstances.--The circumstances referred to in subsection (a)
are that the person committing such war crime or the victim of such war
crime is a member of the Armed Forces of the United States or a national
of the United States (as defined in section 101 of the Immigration and

(1) defined as a grave breach in any of the international
conventions signed at Geneva 12 August 1949, or any protocol to such

I have to say that the war crimes trial looks quite a bit more likely than any terrorism carges (such charges would likely throw into question the idea and practice of war itself, and the powers that be will have no part of that). Unfortunately, it may have to wait until the end of Bush's Residency; the "justice" system will be loathe to charge the man sitting as president, especially during wartime, even if that wartime is a direct result of his regime's war crimes.
