Judge outlaws Radikal articles at XS4ALL

15.04.2002 AMSTERDAM - Monday the Amsterdam court has outlawed two radical left articles on the homepage of an XS4ALL client. Deutsche Bahn demanded the provider take down the protest site.

The homepage of the client contained articles from the radical left magazine Radikal. The articles from 1997 and 1998 gave tips on how to delay nuclear rail transports in Germany. XS4ALL was only ordered to remove the two said articles, but because the provider was not able to do this, the whole site went offline monday morning.

A week ago XS4ALL was summoned to remove the articles, which the provider ignored. "We have a standard complaints procedure if anybody objects to a website of a client", XS4ALL spokes person S. Nas explained. "We ask for a factual explanation of the objections. But the German railways did not give any, they immediately came with a summons."

XS4ALL has one weekend to prepare for the case. It is not clear to Nas why Deutsche Bahn is suddenly in such a hurry. "The site has been online for some four five years already."

Radikal

In 1996 and 1997 much public protest surrounded the Radikal case, when German providers were forced to block their clients from the page. Twice the block was lifted, when it became clear how ineffective the measure was. In the Netherlands the paper version of Radikal was never illegal.

XS4ALL is basically caught in the middle, according to spokesperson Nas. On the one hand XS4ALL has to protect the interests and privacy of the client, on the other hand it has to respect copyright law.
